ARBITRATION AND ALTERNATIVE DISPUTE RESOLUTION IN THE AGRICULTURAL AND RURAL SECTORS

David A Thompson FRICS FAAV is a specialist agricultural arbitrator currently serving on the panel appointed by the President of the Royal Institution of Chartered Surveyors. Specialising in disputes relating to Landlord and Tenant matters under the Agricultural Holdings Act 1986, the Agricultural Tenancies Act 1995 and the Dairy Produce Quota Regulations. Most arbitrations these days are governed by the Arbitration Act 1996 and are usually a last resort where the parties have been unable to come to an agreement in such matters as rent reviews under the Agricultural Holdings Act or Farm Business Tenancies, end of Tenancy Valuation Disputes, Notices to Quit and other related matters. An Arbitrator may only act where there is no conflict of interest and acts in a judicial capacity.
