Situation

The property is located in the popular Breinton area about three miles to the west of Hereford. The property has direct access onto the Breinton Road that leads to the city centre.

The Site

The site is approximately 0.75 acres and includes open grass space and sparse woodland including Ash, Sycamore and Scots Pine trees. Within the land is a disused timber sports pavilion (10.43 x 3.74m) with a veranda to the front and a flat roof shelter to the rear. There is also a further wood shed which measures about 3.70m by 2.47m.

Planning

The vendor made a pre planning application enquiry for a dwelling on the site the conclusion of which stated:

In CS policy terms the site is outside of a settlement, Hereford or any figure 4.14 or 4.15 settlement, and as such policy RA3 applies. A new dwelling as set out in your application, does not meet any of the criteria-based exceptions and as such the proposal is contrary to policy. In light of the present five-year housing land supply deficit, at this time the proposal would be considered against para 14 of the NPPF, and as duplicated in CS policy SS1, and for the reasons set out above it is my opinion that the modest benefits would be significantly and demonstrably outweighed by the adverse impacts, which principally result from its unsustainable location.

You may wish to consider the possibility of conversion of the sports pavilion in accordance with the full requirements of CS policies RA3(4) and RA5.

This advice is given in the context of your request and the information provided in support and has regard to the Council's planning policy. Should you wish to submit a planning application I would recommend that this advice is taken into account. However, this advice is offered without prejudice to any future decision the Council may make following the formal consideration of a planning application.

Method of Sale

The land is available for sale by Formal Tender. A copy of the sale contract and legal documentation is available from the vendors solicitors as detailed below.

Prospective purchasers should carry out their own enquiries with Herefordshire Council and other Authorities before making an offer for the land.

The tender acceptance document should be signed by the proposed purchaser(s) stating the proposed purchase price and should include a deposit cheque of 10% of the purchase price. These are to be received at the Agents Office by Friday 23 November 2018 at 12 noon.

The deposit cheque should be made payable to Humfrys & Symonds'.

All unsuccessful bidders will have their deposit cheque returned to them and unsuccessful contracts and documentation will be destroyed.

The vendors will then confirm which, (if any), proposed offer to purchase is acceptable to them and the Solicitors will then immediately effect an exchange of contracts with a completion date of 21st December 2018 (or earlier by mutual agreement).

The Tender is legally binding. No further negotiations will be entered into after the Tender closing date.

0.2 miles as indicated by the Agents For Sale' board.
